Magic Jake Booking Policy & terms
These Terms & Conditions apply to all bookings made with Magic Jake Entertainment. By confirming a booking, the client acknowledges they have read, understood, and agreed to the following terms.
1. Booking Confirmation
A booking is considered confirmed once:

Written confirmation has been issued by Magic Jake, and
-
The client proceeds with the booking or provides confirmation via email or invoice acceptance.

2. Payment Terms

An invoice will be sent via email following booking confirmation.

Full payment is due 7 days prior to the event date, unless otherwise agreed in writing.
-
Failure to make payment by the due date may result in cancellation of the booking.
-
All pricing is in AUD and inclusive or exclusive of GST as specified on the invoice.

3. Cancellations & Changes
Client Cancellations:
-
More than 7 days’ notice: No cancellation fee.
-
Less than 7 days’ notice: Up to 50% of the total booking fee may be charged.
-
Less than 48 hours’ notice: Up to 100% of the booking fee may be charged.
Changes:
Requests to change the date, time, or location are subject to availability and must be made as soon as possible.

4. Performer Cancellation
In the unlikely event that Magic Jake is unable to perform due to illness, emergency, or circumstances beyond reasonable control:

A full refund will be provided, or
-
A suitable replacement performer may be offered where possible, subject to client approval.

5. Event Access & Setup

Setup time is not included within the booked performance timeframe unless agreed otherwise in writing.

Depending on the size of the show, Magic Jake may require access to the performance space up to 90 minutes prior to the scheduled start time for setup and safety checks.

The client is responsible for ensuring clear, safe, and uninterrupted access during this period.
-
The performance area must be safe, level, dry, and free from hazards. Magic Jake reserves the right to modify the performance if safety requirements are not met.

6. Performance Space & Technical Requirements

The client agrees to provide a suitable performance area appropriate for the booked show.

Where required, access to power, shade, or indoor space must be provided.
-
If space limitations or safety concerns arise, Magic Jake may adjust or scale the performance accordingly.

7. Performance Conditions & Audience Supervision

Magic Jake provides interactive, family-friendly entertainment suitable for mixed audiences.
-
Children must remain under adult supervision at all times. Magic Jake is not responsible for supervising children outside of the performance itself.

Magic Jake reserves the right to pause or end a performance if behaviour becomes unsafe, aggressive, or excessively disruptive.
8. Outdoor Events & Weather

Magic Jake will not perform outdoors in unsafe weather conditions. This includes rainfall, extreme heat, high winds, lightning, or other unsafe environmental factors.

Magic Jake reserves the right to refuse, pause, or stop a performance if conditions are deemed unsafe for the performer, equipment, or audience.

The client is responsible for organising a suitable indoor or weather-protected backup area where the performance can proceed without interference from weather.

If an outdoor event cannot proceed due to weather and no suitable backup location is provided:

The booking fee remains payable
-
Refunds or rescheduling are not guaranteed.

9. Photography, Video & Media Use

Photos, videos, or other media captured during the event — whether taken by Magic Jake, the client, or third parties — may be used by Magic Jake Entertainment for promotional and marketing purposes, including social media, website content, and advertising.

If the client prefers that images from their event not be used publicly, this must be requested in writing prior to the event date.
10. Recording & Intellectual Property

Magic Jake’s performance content, routines, and material remain the intellectual property of Magic Jake Entertainment.
-
Recording for commercial, instructional, or redistribution purposes is not permitted without prior written consent.
11. Late Starts, Delays & Travel
-
Magic Jake will arrive allowing reasonable travel time; however, delays caused by venue access issues, traffic, or client readiness may result in a reduced performance time.

If the event starts late due to circumstances outside Magic Jake’s control, the performance may finish at the originally agreed end time.

12. Liability & Insurance
Magic Jake holds appropriate public liability insurance.
To the extent permitted by law, Magic Jake is not liable for injury, loss, or damage caused by:

Venue conditions or third parties
-
Client-provided equipment
-
Circumstances outside reasonable control.

13. Force Majeure
Neither party shall be held responsible for failure to perform obligations due to events beyond reasonable control, including natural disasters, government restrictions, or emergencies.

14. Acceptance of Terms
By confirming a booking, replying to a booking confirmation email, or proceeding with payment, the client acknowledges acceptance of these Terms & Conditions
